Molloy LLC (2018Molloy,2019 2018we,2019 2018our,2019 or 2018us2019) operates the SalesMax Plus platform and its associated services, including the Missed Opportunity Alert System and A2P SMS text message alert service, accessible at salesmaxplus.com and my.salesmaxplus.com. This Privacy Policy explains how we collect, use, store, share, and protect personal information in connection with those services.
 
This policy applies to all users of the SalesMax Plus platform, including customer administrators, Alert Managers, and Alert Supervisors, as well as visitors to salesmaxplus.com. By using SalesMax Plus or visiting our website, you acknowledge the practices described in this Privacy Policy.



2. To Whom This Policy Applies


This Privacy Policy applies to the following individuals:

  • Website Visitors: individuals who visit salesmaxplus.com for informational purposes.

  • Customer Administrators: employees of SalesMax Plus customer organizations who manage user roles and system settings within the platform.

  • Alert Managers: employees assigned by a customer administrator to receive SMS text message alerts for a specific store or location.

  • Alert Supervisors: employees assigned by a customer administrator to receive SMS text message alerts across all stores or locations within their organization.

 
References to ‘you’ or ‘users’ throughout this policy encompass all of the above.



3. Information We Collect


​3.1 Website Visitor Information (salesmaxplus.com)
When you visit salesmaxplus.com, we may collect:

  • Personal information you voluntarily provide, such as your name, email address, phone number, company name, and job title, when you complete a contact form, request a consultation, register for a webinar, or subscribe to our newsletter.

  • Usage information, including IP address, browser type, operating system, pages visited, and time spent on the site, collected through cookies and similar technologies.

3.2 Platform Account and Profile Information
When a user account is created within SalesMax Plus, we collect:

  • Full name and business email address

  • Mobile phone number (used for SMS alert delivery)

  • Employer organization and store or location assignment

  • User role within the platform

3.3 Consent and Role Assignment Records

When a customer administrator assigns an employee to an Alert Manager or Alert Supervisor role, the system captures and logs a consent record including:

  • The SMP user ID of the employee being assigned

  • The role being assigned

  • Consent status (Opted In or Opted Out)

  • The SMP user ID of the administrator making the assignment

  • A UTC timestamp of the action

  •  

3.4 SMS Alert Activity


In connection with the delivery of SMS text message alerts, we may collect or process:

  • Mobile phone numbers to which alerts are sent

  • Alert delivery timestamps and alert type

  • User interactions with my.salesmaxplus.com, including login events and alert review and resolution activity

 

3.5 Call and Alert Data


The SalesMax Plus platform processes call data to generate missed opportunity alerts. This may include:

  • Date, time, and duration of calls

  • Store or location associated with a call

  • Caller identification information

  • Call recordings are accessible to authorized users for reviewing missed opportunity events

  • Language KPI analysis results that triggered an alert

 

3.6 Usage and Session Data


We may collect technical information related to your use of the platform, including session authentication state, browser type, and access timestamps, for the purposes of security, system functionality, and platform improvement.

  • To deliver SMS text message alerts to users who have been enrolled by their customer administrator.

  • To respond to website inquiries, consultation requests, and service questions.

  • To send marketing communications such as newsletters and promotional emails to website visitors who have opted in (you may opt out at any time).

  • To authenticate platform users and route them to the appropriate portal areas.

  • To enable Alert Managers and Alert Supervisors to review, action, and resolve missed opportunity alerts.

  • To maintain consent and opt-in/opt-out records in compliance with A2P 10DLC SMS regulations.

  • To generate reporting on alert volume, recovery activity, and response times.

  • To analyze website traffic and usage patterns.

  • To maintain the security, integrity, and proper functioning of the platform.

  • To comply with applicable legal obligations.

 
 

5. SalesMax Plus SMS Consent and Opt-In / Opt-Out


SMS Disclosure: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. SMS opt-in data and consent records will not be shared with any third parties.

 
5.1 How Consent Is Collected
The SalesMax Plus SMS alert service uses an employee-driven, application-authenticated consent model. Enrollment is initiated by a customer administrator but requires the employee's own explicit confirmation before any messages are sent.
 
When an administrator assigns an employee to an Alert Manager or Alert Supervisor role, the employee's consent is set to inactive and no messages are sent. The next time the employee logs into SalesMax Plus, they are presented with a consent popup describing the alert service, message frequency, and how to opt out. If the employee agrees, their consent status is updated and a consent record is created. If the employee declines, no messages are ever sent.
 
Upon confirmation, the system sends a single activation message: "Welcome to SalesMax Plus alerts. Reply START to activate alert delivery to this number. Msg & data rates may apply. Reply STOP at any time to opt out." Alert delivery begins only after START is received.


5.2 Message Frequency and Content
Message frequency varies based on missed sales opportunity events at the user's assigned location or organization. Each alert message reads: "SalesMax Plus Alert: Missed Sales Opportunity. Type smpalerts.com in your browser to access the alert just received. To stop alerts reply STOP or contact your SalesMax Plus administrator. Msg & data rates may apply."
 
SMS alerts are automated, event-driven operational notifications. They are not promotional or marketing messages.

 

5.3 Supported SMS Keywords

STOP — Unsubscribe immediately. You will receive one confirmation message and no further alerts will be sent. Your administrator will be notified.

START — Used during the enrollment activation flow to begin alert delivery after confirming consent.

HELP — Receive support contact information: support@molloyllc.com | 877-212-6001.

 

 

5.4 Opting Out
An enrolled user may opt out by replying STOP to any alert message or by having their alert role removed by a customer administrator. A STOP reply resets consent and removes the alert role. All opt-out events are logged with the user ID, method, and UTC timestamp.

 

5.5 Re-Enrollment After a STOP
To receive alerts again after a STOP, the full enrollment cycle must be completed: the administrator assigns the role, the employee confirms consent via the in-app popup, the system sends the activation message, and the employee replies START.

 

5.6 Carrier Liability
Carriers are not liable for delayed or undelivered messages. Message and data rates from your mobile carrier may apply.
 

 

6. AI MAX Agent Service SMS - Data Collection and Use

MolloyLLC uses the SalesMaxPlus AI Max Agent Service to handle inbound phone calls on behalf of our business. When you call, the AI agent captures the nature of your call — such as an appointment request, vehicle status inquiry, service or price question, or general inquiry. If you consent to receive a text message during your call, your mobile phone number is collected for the sole purpose of sending you that message.

What we collect- The nature of your call (appointment request, vehicle status, service/price inquiry, general inquiry)- Your mobile phone number, only if you consent to receive a text message.

 

How we use it- Call details are sent to our store manager so your request can be handled appropriately- Your mobile phone number is used only to send the text message(s) you requested- We do not use your phone number for marketing or promotional messages.

 

How we protect it - Your mobile phone number and call details are not sold, rented, or shared with third parties for marketing purposes. Call data is processed by SalesMaxPlus (a service of Molloy LLC) on our behalf solely to operate this service. 

 

How long we keep it - Call and message data is retained only as long as necessary to fulfill your request or as required by applicable law. 

 

Opting out of SMS - You may opt out of SMS messages at any time by replying STOP to any message.


 

7. How We Share Your Information

 

Molloy LLC does not sell personal information. We may share information in the following limited circumstances:

  • Website Hosting and Infrastructure Providers: We work with third-party providers for website hosting, server infrastructure, and content delivery.

  • CRM and Marketing Automation Platforms: We use platforms to manage customer relationships, email communications, and marketing outreach on our behalf.

  • Call Tracking and Analytics Services: We use call tracking and analytics tools to support platform functionality and performance reporting.

  • SMS Delivery Providers: We work with telecommunications carriers and SMS gateway providers participating in the A2P 10DLC program to deliver text message alerts.

  • AI Agent and Automation Platforms: We use third-party platforms to support AI agent functionality within the SalesMax Plus platform.

Website Building and Content Delivery Platforms: We use platforms that support the operation and delivery of our public website.


 


These providers are permitted to use your information only as necessary to deliver services on our behalf and are not permitted to use it for their own purposes.

 
We may also share information in the following circumstances:

  • Customer Organizations: Information about your role, alert activity, and resolution outcomes is visible within the platform to other authorized users in your organization.

  • Legal Compliance: We may disclose information if required by law, legal process, or governmental authority.

  • Business Transfers: In the event of a merger, acquisition, or sale of assets, your information may be transferred as part of that transaction.


8. Data Retention


We retain personal information for as long as necessary to fulfill the purposes described in this policy, to maintain accurate consent records as required for A2P 10DLC compliance, and to meet applicable legal obligations.
 
Contact and account information collected through salesmaxplus.com is typically retained for the duration of our business relationship and for a reasonable period thereafter. You may request deletion of your personal information at any time by contacting us at support@molloyllc.com.
 
Consent log records reflect the current state of each user's enrollment. Alert records, call data, and resolution outcomes are retained in accordance with our standard data retention practices and any applicable contractual obligations with customer organizations.

 
9. Data Security


We implement reasonable technical and organizational measures to protect your personal information, including HTTPS encryption for data in transit, access controls limiting data access to authorized personnel based on user role, session management, and reputable third-party hosting infrastructure.
 
In the event of a data breach that affects your personal information, we will notify affected individuals in accordance with applicable law. No method of electronic transmission or storage is completely secure, and we cannot guarantee absolute security.



10. Your Rights and Choices

  • Opt-Out of Marketing: You can opt out of receiving marketing emails by following the unsubscribe instructions in any email or by contacting us directly.

  • Cookies: You can control the use of cookies through your browser settings.

  • Access and Correction: You may request access to or correction of your personal information by contacting us.

  • Deletion: You may request deletion of your personal information by contacting us at support@molloyllc.com.

 
As noted in Section 5, enrollment in the SMS alert service is managed through your employer's SalesMax Plus administrator. To opt out of text alerts, reply STOP to any alert message or contact your administrator.


 
11. Children's Privacy


The SalesMax Plus platform and website are intended solely for use by authorized business personnel and individuals 18 years of age or older. We do not knowingly collect personal information from individuals under the age of 18. If we become aware that we have collected personal information from a minor, we will take steps to delete that information promptly.
 
11. Changes to This Privacy Policy


We may update this Privacy Policy from time to time to reflect changes in our practices, the SalesMax Plus platform, or applicable law. When we make material changes, we will update the Effective Date at the top of this document and post the updated policy at salesmaxplus.com/privacy-policy. Continued use of the platform or website following notice of changes constitutes acceptance of the updated policy.
